RE: The tariff classification of a men’s knit cardigan from Vietnam.

Dear Mr. Anuschat:

In your letter dated March 15, 2007, you requested a tariff classification ruling on behalf of Fred Meyer, Inc. /The Kroger Co. As requested, your sample will be returned.

Style 69347 is a men’s cardigan constructed from 96% cotton, 4% spandex, jersey knit fabric that measures 29 stitches per 2 centimeters counted in the horizontal direction. The garment features a self-fabric stand up collar, a full front opening with a zippered closure, long raglan sleeves with rib knit cuffs, side seam pockets below the waist, and a loose fitting rib knit bottom.

The applicable subheading for Style 69347 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys': other. The duty rate is 16.5% ad valorem.

Style 69347 falls within textile category designation 338.
