RE: The tariff classification of an unbleached or bleached 100% nylon warp knit fabric from the Dominican Republic.

Dear Mr. Nagel:

In your letter dated February 26, 2007 you requested a tariff classification ruling. The sample you submitted is being returned as requested.

The submitted sample, designated as style WK0427, is a warp knit fabric composed of 100% filament nylon. It is constructed using a combination of 20 denier multifilament nylon yarns and 15 denier monofilament nylon yarns. Weighing approximately 27 g/m2, this product will be imported in 137 centimeter widths.

The applicable subheading for the warp knit tricot fabric designated as style WK0427 will be 6005.31.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for warp knit fabrics (including those made on galloon knitting machines), other than those of headings 6001 to 6004, of synthetic fibers, unbleached or bleached, other, other. The rate of duty will be 10 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

It should be noted that there is a possibility that this product may be eligible for a free rate of duty under the Dominican Republic-Central American-United States Free Trade Implementation Act. However, you have not supplied sufficient information for us to make a determination of whether this act applies to your product. In order for a product to be eligible for the reduced duty, it must comply with the terms of the act as enumerated in General Note 29 of the HTSUS. If you believe that your product may be eligible, please provide a complete description of each step in the manufacturing operation including where each step is performed. In addition, provide the country of origin of each material that is incorporated into the final product including where the fiber is produced and where the yarns are produced as well as where any finishing chemicals or other reagents used in the manufacture of this item are made.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
