RE: The tariff classification of a men’s knit pullover from China.

Dear Mr. Wong:

In your letter dated February 27, 2007, you requested a tariff classification ruling on behalf of F.J. & M Inc. As requested, your sample will be returned.

Style A970 is a men’s pullover garment constructed from 60% cotton, 40% acrylic, 4x2 rib knit fabric that measures 15 stitches per 2 centimeters counted in the horizontal direction. The garment has a full cut and sewn lining of 100% polyester, finely knit fabric that is laminated to a breathable polyurethane membrane. Style A970 features a stand-up collar, a partial front opening with a zippered closure, long sleeves with rib knit cuffs, and a rib knit bottom.

The applicable subheading for Style A970 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem.

Style A970 falls within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
