RE: The tariff classification of a needleloom felt material, for use in various civil engineering and other environmental projects, from China.

Dear Mr. Anderson:

In your letter dated March 1, 2007, which was a follow-up to an earlier inquiry where we requested additional information, you requested a tariff classification ruling. This ruling is on behalf of Contech Construction Products Inc., 9025 Centre Pointe Drive, West Chester, Ohio.

The instant sample, identified as style # C70NW, consists of a needlooom felt material that is composed of 100 percent polypropylene man-made fibers (staple). This material has been heat set on one surface and weighs approximately 200 grams per square meter. You write that this material will be imported as roll goods having widths ranging from 150 to 180 inches. This material has application in various geotextile situations such as subsurface soil drainage and separation and soil cushioning in civil or environmental engineering projects such as roadways, railroad or landfill systems developments.

The applicable subheading for the material will be 5602.10.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for needleloom felt and stitch-bonded fiber fabrics, ..., of other than wool or fine animal hair. The duty rate will be 10.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
