RE: The tariff classification of compressed washcloth from China

Dear Mr. Maher:

In your letter dated February 28, 2007 you requested a classification ruling on behalf of Hoop Retail Stores LLC.

The submitted sample, identified as style # Magic Bath Toy D18756001 , is a compressed washcloth. The washcloth is made from 100 percent cotton printed terry fabric. One side has cut loops and the reverse uncut loops. The edges are finished with an overcast stitch. The compressed washcloth measures 2.5 inches wide with five pointed stars. Uncompressed, the washcloth measures 12 inches square.

The applicable subheading for the compressed washcloth will be 6302.60.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton other. The duty rate will be 9.1 percent ad valorem.

The washcloth fall within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
