RE: The tariff classification of insulated food bag from China

Dear Ms. Davidson:

In your letter dated February 20, 2007, you requested a classification ruling. Your sample is being returned.

The sample submitted, style number 10041266, is a soft-sided insulated food bag that is designed to provide storage, protection, organization, and portability to food and beverages during travel. It is also designed to maintain the temperature of food and beverages. The bag is constructed with an outer surface of polyester woven fabric. The interior is lined with polyvinyl chloride plastic sheeting material. There is a layer of foam plastics between the polyester fabric and the PVC lining. The bag measures approximately 9” (W) x 8” (H) x 6” (D). It features two carrying handles, a top zippered opening, a front zippered pocket, and a back pouch pocket. There is also a removable pouch inside the bag that is constructed of polyethylene vinyl acetate (PEVA) plastic.

The applicable subheading for the insulated food bag will be 4202.92.0807, Harmonized Tariff Schedule of the United States (HTSUS), which provides for insulated food and beverage bags, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 7% ad valorem.

HTS 4202.92.0807 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
