RE: The tariff classification of a Christmas Stocking Stand #58730 from China

Dear Ms. Ramsey:

In your letter dated February 15, 2007 you requested a tariff classification ruling.

The Christmas Stocking Stand #58730 is a dark green iron pole measuring 60 ¾” in height with six hooks attached to hang Christmas stockings and is topped with an undecorated tree. The Christmas Stocking Stand #58730 is a practical and decorative alternative for homeowners who do not have a mantel to hang Christmas stockings during the Christmas holiday. Therefore, the Christmas Stocking Stand #58730 functions as an accessory to a Christmas stocking, which is an article traditionally used at Christmas festivities.

The applicable subheading for the Christmas Stocking Stand #58730 will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be Free.
