RE: The tariff classification of a costume from China.

Dear Mr. Fragomeli:

In your letter dated February 12, 2007, you requested a tariff classification ruling.

You submitted the following textile costume skirt, which meets the flimsy requirements for classification within Chapter 95 and is being returned upon your request.

Item 6831119, Plaid Mini Skirt Assortment, is a textile costume skirt assortment made of woven polyester with an attached vinyl belt. Although the skirt has a belt with multiple layer styling and a well-made edge, the skirt has a flimsy waist and seams and a flimsy edge at the bottom.

The applicable subheading for item 6831119, Plaid Mini Skirt Assortment, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HSTUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
