RE: The tariff classification of men’s woven shirts from Bangladesh and Pakistan.

Dear Ms. Hodur:

In your letter dated February 13, 2007, you requested a tariff classification ruling on behalf of Chaps Men’s. As requested, your samples are being returned.

Styles D83706, D83712 and D83713 are men’s shirts constructed from 100% cotton, woven, yarn dyed plaid flannel fabric. The garments have a full lining of a quilted woven taffeta fabric with a lightweight fiberfill batting. Styles D83706, D83712 and D83713 feature a self-fabric spread collar; a left over right, full front opening secured by six button closures; patch pockets on the chest with flaps and button closures; long vented sleeves with a one button closure on each cuff; side seam pockets below the waist; and a curved hemmed bottom. The submitted garments are in size Medium.

The applicable subheading for Styles D83706, D83712 and D83713 will be 6205.20.2047, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ shirts: of cotton: other: other: other: with two or more colors in the warp and/or the filling: napped. The duty rate will be 19.7% ad valorem.

Styles D83706, D83712 and D83713 fall within textile category designation 340. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
