RE: The tariff classification of duffle bag and a toiletry bag from China

Dear Ms. Stanczak:

In your letter dated February 9, 2007, you requested a classification ruling.

The submitted samples are identified as style B20. Style B20 consists of a duffle bag and a toiletry bag that are constructed with an outer surface of 100% cotton canvas. The duffel bag features a main storage compartment with a top zippered opening, two carrying handles, an exterior zippered pocket and an adjustable shoulder strap. The toiletry bag has a metal hook for hanging. The interior has three storage pouches with zipper closures. The bags are designed to carry clothing, ballet shoes, and other personal effects during travel. This office is retaining the bags as official samples.

The applicable subheading for the duffle bag and the toiletry bag will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport, and similar bags, with outer surface of textile materials, not of pile or tufted construction, of cotton. The rate of duty will be 6.3% ad valorem.

HTSUS 4202.92.1500 falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
