RE: The tariff classification of item # 951342, known as “Beware Drips of Blood” imported from China

Dear Ms. Aldinger,

In your letter dated February 1, 2007, you requested a tariff classification ruling.

Item # 951342, which is known as “Beware Drips of Blood”, is composed of 100% gooey red plastic that is sticky and spells “Beware” in imitation dripping blood when it is stuck to windows. The dripping blood is 8” in height by 11” in length, and comes packaged in a sealed plastic bag with an illustrative cardboard header.

Item # 951342, “Beware Drips of Blood”, is for purely decorative purposes to be used in the home to create an atmosphere of fright during the Halloween holiday.

The applicable subheading for item # 951342, “Beware Drips of Blood” will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
