RE: The tariff classification of bags from China. Correction to Ruling Number M86639

Dear Ms. Kelly-Kobayashi:

This replaces Ruling Number M86639, dated October 6, 2006, which contained a typographical error. The incorrect classification was provided in the original letter. A complete corrected ruling follows.

The item that you refer to as a “Rat Bag” is a travel bag constructed from 100% cotton textile fibers. It features one main storage compartment with a top zipper closure, two reinforced carrying handles, one zippered side pocket, two outer pouch pockets, and a detachable shoulder strap. It is designed to contain personal effects and accessories on a daily basis.

The item that you refer to as “Bananas” is a travel bag constructed from 100% jute textile fibers. It features one main storage compartment with a drawstring closure, two outer zippered pockets, and an adjustable shoulder strap. It is designed to contain personal effects and accessories on a daily basis.

The applicable subheading for the “Rat Bag” will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides, in part, for travel, sport, and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The rate of duty will be 6.3% ad valorem.

The applicable subheading for the “Bananas” Bag will be 4202.92.2000, HTSUS, which provides, in part, for travel, sport, and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, other. The rate of duty will be 6.3% ad valorem.

HTSUS 4202.92.1500 falls within textile category designation 369. HTSUS 4202.92.2000 falls within textile category designation 870. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
