RE: The tariff classification of a men’s knit polo shirt from China.

Dear Mr. Ovan:

In your letter dated January 25, 2007, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 3584TS is a men’s polo shirt constructed from 95% polyester, 3% spandex, 2% metallic finely knit fabric. The metallic is a single yarn composed of a metallized filament and nylon. The fabric measures 24 stitches per linear centimeter counted in the horizontal direction and 22 stitches per linear centimeter counted in the vertical direction. Style 3584TS features a rib knit spread collar; a partial front opening with three button closures; short, raglan sleeves with rib knit cuffs; a small heat seal on the lower left front panel; and a straight, hemmed bottom with side slits and a tail.

The applicable subheading for Style 3584TS will be 6105.20.2010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ shirts, knitted or crocheted: of man-made fibers: other: men’s. The rate of duty is 32% ad valorem.

Style 3584TS falls within textile category designation 638. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
