RE: The tariff classification of tube scarf from China.

Dear Ms. Ramsey:

In your letter dated February 1, 2007, you requested a classification ruling. The samples will be returned to you.

The submitted samples, styles 55230/Black and 55234/Grey tube scarves are made of knit 100% polyester fleece fabric. The scarf is approximately 66” long with a tube attached by a zipper. The tube has a drawcord on one end. The item is worn as a scarf with turtleneck or as a balaclava to cover the nose, cheeks and chin. The tube scarf does not cover the head. The tube scarf also comes in styles 55321/Navy, 55232/Ivory, and 55233/Royal Blue

The applicable subheading for styles 55230, 55231, 55232, 55233 and 55234 will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories, knitted or crochetedShawls, scarves, mufflers, mantillas, veils and the like: Of man-made, Other." The duty rate will be 11.3% ad valorem. The textile category designation is 659.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
