RE: The tariff classification of pillow covers from China, Hong Kong and Taiwan

Dear Ms. Tolchin:

In your letter dated February 6, 2007 you requested a classification ruling on behalf of Sew Fun, Inc.

The submitted samples are described as “Tooth Fairy Pillow Covers”. The covers are made from 100 percent cotton woven fabric. Both covers feature a side opening with two fabric ties. One cover measures 12 x 15 inches. The face of the cover is embroidered with the word “Princess” and a crown appliqué that contains embroidery. The second cover measures 12 x 16. The face of the cover is embroidered with the phrase “All Star” and different sport balls. Both covers have a small pocket for the insertion of a tooth.

The applicable subheading for the pillow covers will be 6304.92.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of cotton. The duty rate will be 6.3 percent ad valorem.

The pillow covers falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
