RE: The tariff classification of handbag and two tote bags from India and China

Dear Ms. Daniels:

In your letter dated January 24, 2007, you requested a classification ruling on behalf of your client, Barganza, Inc. Your samples are being returned to you.

Style number 32-5620 is a tote bag. You state in your ruling request that it is manufactured with an exterior surface of 100% leather. It has an open top that is secured by a snap closure and is carried by means of double carrying handles. It also has a textile lined divided interior compartment with various wall pockets to hold a cell phone, eyeglasses, pens, etc. The exterior of the bag has two additional zippered pockets. It is designed to provide storage, portability, organization, protection and other personal effects during travel. It measures approximately 17” (W) X 15” (H) x 3” (D).

Style number 75-25562 is a tote bag manufactured with an exterior surface of 100% plastic sheeting material. The tote bag features an undivided textile lined interior compartment with one wall pocket. The top of the bag is secured by means of a zippered closure and is carried by means of double handles. It is designed to provide storage, portability, organization, protection and other personal effects during travel. It measures approximately 15.5” (H) X 17” (W) X 4” (D).

Style number 78-10427 is a handbag manufactured with an exterior surface of 100% cotton canvas with polyvinyl chloride (PVC) trim. It is designed and sized to contain the small personal effects that a woman would carry on a daily basis. The handbag features an undivided textile lined interior with one wall pocket to hold a cell phone and one zippered wall pocket. The exterior of the bag has two additional side pockets trimmed with PVC material. The top of the bag is secured by means of a zippered closure and is carried by double handles. It measures approximately 7.5” (H) X 12” (H) X 5.25” (D).

The applicable subheading for Style 32-5620 will be 4202.91.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of leather. The duty rate will be 4.5 percent ad valorem.

The applicable subheading for Style 72-25562 will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic. The duty rate will be 20 percent ad valorem.

The applicable subheading for Style 78-10427 will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.3 percent ad valorem.

HTS 4202.22.4500 falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
