RE: The tariff classification of flashlights from China.

Dear Ms. Lin:

In your letter dated January 17, 2007, you requested a tariff classification ruling.

The merchandise under consideration is the Sportsman LED Light Set (Model #TSKCLD), which consists of two small flashlights packaged together. The two flashlights are identified as the Flex Light and Clip Light. Samples of the two flashlights were provided with your ruling request and will be returned to you.

The Flex Light is a small battery operated Light Emitting Diode (LED) flashlight constructed entirely of metal, with a push button switch. The main body measures approximately 1½ inch long with a inch diameter, and has a pen clip and swivel key ring attached to it. Extending out from the opposite end of the main body is an LED light mounted at the tip of a 2¼ inch length of inch flexible metallic tubing. The Clip Light is a small battery operated LED flashlight constructed of metal, with a push button switch. This flashlight measures approximately 2½ inches long with a diameter of ½ inch and has a swivel key ring attached to it. The Clip Light flashlight also features a plastic holder with a spring clip and swivel joint specifically designed for use with this flashlight.

The applicable subheading for the Flex Light and Clip Light will be 8513.10.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Portable electric lamps designed to function by their own source of energy: Lamps: Flashlights.” The general rate of duty will be 12.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
