RE: The tariff classification of an adult unisex costume from China.

Dear Mr./Ms. Fragomeli:

In your letter dated January 18, 2007, you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, item 6801545M, Ken Costume Set consists of a tunic, pants, belt and faux boxing gloves. You state that the tunic and pants are made of woven 100% polyester fabric. Examination reveals that they are made of knit fabric. The tunic has a full front opening, two-layered placket with multiple stitching on each side and slits at the bottom. The flimsy pants have an elastic waist.

The tunic is well made with a multiple stitched and layered placket, finished edges and styling.

The Ken Costume Set will also be imported in size small, Item 6801544S and size large, 6801546L.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the tunic imparts the essential character of the set.

The applicable subheading for the Ken Costume Set items 6801545M, 6801544S and 6801546L will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Other, Other: Women’s or girls’." The rate of duty will be 14.9% ad valorem. The textile category designation is 659.
