RE: The tariff classification of girl’s sleepwear from China.

Dear Ms Malina:

In your letter dated January 17, 2007, you requested a classification ruling. As requested, the sample will be returned to you.

The submitted sample, style #246726 (toddler and little girl sizes), is a girl’s pajama pant constructed of knit polyester fleece fabric. The loose fitting sleep pants feature an enclosed elasticized waistband and hemmed bottom. The garment is designed and marketed as a pajama pant. It will be sold in a your catalog within the sleepwear pages as sleepwear for kids and will be paired with a flame retardant cotton PJ tee. The pajama pants will have a sewn in fabric tag at the inside waist that states they are flame resistant sleepwear. Style #246727 is the same item manufactured in larger girls’ sizes.

Nightwear for children in sizes 0-14 is subject to the flammability standards of the Consumer Products Safety Commission, (CPSC). Please contact the CPSC regarding compliance.

The applicable subheading for styles #246726 and #246727 will be 6108.92.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ slips, petticoats, briefs, panties, night dresses and pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: other: of man-made fibers, other: girls’. The duty rate will be 16 percent ad valorem.

Styles #246726 and #246727 fall within textile category 652. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
