RE: The tariff classification of a compartmented relish dish from Taiwan

Dear Ms. Ramsey:

In your letter dated January 11, 2007, you requested a tariff classification ruling.

You have submitted a picture of a two-part dish, identified as item 58740, made of translucent acrylic plastic. It consists of two shallow bowls joined by a narrow bridge. The larger compartment has a capacity of one cup; the smaller compartment has a capacity of one-half cup. The descriptive literature suggests that the dish or bowl is suitable for serving olives, pickles, nuts, candy or cheese cubes or may be used to hold dips and sauces.

The applicable subheading for the compartmented relish dish will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tableware, kitchenware, other household articlesof plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
