RE: The tariff classification of a “yogurt soda” from Canada

Dear Mr. Khabbazi:

In your letter dated January 11, 2007, you requested a tariff classification ruling.

The subject merchandise is described as a “yogurt soda”. It is stated to contain 90.0 percent carbonated water, 4.0 percent yogurt (yogurt contains: 3.0 percent milk, 1.0 percent bacterial culture), Herbal extract (extract contains: 2.0 percent basil, 2.0 percent thyme) and 2.0 percent salt.

The applicable subheading for the yogurt soda will be 2202.10.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Waters, including mineral waters and aerated waters, containing added sugar or other sweetening matter or flavored, and other nonalcoholic beverages, not including fruit or vegetable juices of heading 2009: Waters, including mineral waters and aerated waters, containing added sugar or other sweetening matter or flavoredOther. The duty rate will be 0.2 cents per liter.
