RE: The tariff classification of a women’s jacket from China

Dear Mr. Hyland:

In your letter dated January 12, 2007, you requested a classification ruling.

The sample submitted, style number BP124368, is a woman’s lower hip-length jacket with a shell composed of a woven twill 99% cotton/1% spandex fabric. The jacket is not lined.

The jacket is fitted at the waist and has an integral hood that is secured at the chin area by a tab with a two-button closure and a full front opening that is secured by a zipper closure. An overlapping flap with a one-button closure at the top and a one-button closure at the bottom covers the zipper area. The jacket has long vented sleeves with a two-button closure on the cuffs, two free-hanging overlay front yokes, a self-fabric tie belt at the waist that is held to the garment by belt loops that have a one-button closure, two front double-entry bellows pockets below the waist that are secured by flaps with a two-button closure, a pleat along the center portion of the rear panel and a straight cut hemmed bottom.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6202.92.2061, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks, windbreakers and similar articles: of cotton: other: other. The duty rate will be 8.9 percent ad valorem.

The jacket falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
