RE: The tariff classification of gloves from China.

Dear Ms. McCabe:

In your letter dated December 29, 2006, you requested a classification ruling.

You have submitted two pairs of gardening gloves that you state will be sold together as a “mom and me glove set.” The two-pair pack of gloves will be designated style #TGP7-8, and each pair of gloves within the pack will be designated a different style number. Style #TG764 is the adult pair, which you refer to as a “ladies gripper glove” made of 100% cotton knit fabric that has been dip coated in 100% rubber. Only a small portion of the backside, as well as the ribbed knit cuffs, remains uncoated by the rubber. You state that the component weight breakdown of the gloves is 60% rubber and 40% cotton.

Style #TG7537K is the children’s pair of gloves, which are clute cut gloves that you state are made of 100% cotton knit jersey, with ribbed knit cuffs.

The applicable subheading for style #TG764 will be 6116.10.6500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other. The duty rate will be 7% ad valorem.

The applicable subheading for style #TG7537K will be 6116.92.6420, HTSUS, which provides for gloves, mittens and mitts, knitted or crocheted: other: of cotton: other: made from a pre-existing machine knit fabric: without fourchettesjersey type, brushed or napped fabric. The duty rate will be 23.5% ad valorem.

Style #TG7537K falls within textile category 331. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
