RE: The tariff classification of an LCD module from Japan or Hungary.

Dear Ms. Nara:

In your letter dated December 22, 2006 you requested a tariff classification ruling. The submitted sample will be returned to you.

The merchandise under consideration is Sharp’s LQ057Q3DC12 liquid crystal display (LCD) module. The LQ057Q3DC12 is a module of a color active matrix LCD, incorporating amorphous silicon thin film transistor (TFT). It is composed of a color TFT-LCD panel, driver integrated circuits, control printed circuit board, flexible printed circuits, front and back polarizer, sealed case, and backlight unit. In our telephone conversation, you stated that it also has row and column drivers. The LCD module has a resolution of 320 by 240 pixels, and displays 262,144 colors. The active display area is 115.2 millimeters (mm) horizontally and 86.4 mm vertically, and the dot pitch is approximately .36 mm. The module operates by the input signal of QVGA or VGA signals, and, in its imported condition, is not capable of processing any video input such as NTSC, PAL, or SECAM signals. The LQ057Q3DC12 LCD module is designed to be connected to a machine that incorporates an automatic data processing (ADP) machine which controls the LCD display and other components in order to achieve the specific functions for which the machine is designed.

In your ruling request you suggest a classification of 9013.80.7000. However, the LQ057Q3DC12 LCD module is an automatic data processing module which meets Note 5(B) to Chapter 84, Section XVI, Harmonized Tariff Schedule of the United States (HTSUS). Thus, it is more specifically provided for under subheading 8471.

The applicable subheading for the LQ057Q3DC12 LCD module will be 8471.60.3000, HTSUS, which provides for: Automatic data processing machines and units thereof: Input or output units, whether or not containing storage in the same housing: Display units: Without cathode-ray tube (CRT), having a visual display diagonal not exceeding 30.5 cm. The general rate of duty will be Free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

Pursuant to title 19 United States Code, Section 3005 The Harmonized Tariff Schedule of the United States is in the process of being amended to reflect changes recommended by the World Customs Organization. The amendments are expected to affect the classification of your merchandise. On January 4, 2007, Presidential Proclamation 8097 containing these changes was published in the Federal Register. See 72 FR 453, Volume 72, No. 2. The proclaimed changes are effective for goods entered or withdrawn from warehouse for consumption on or after February 3, 2007. Once those changes are in effect, it is anticipated that your merchandise will be classified in 8528.51.0000 HTSUS.
