RE: The tariff classification of a rug from India

Dear Ms. Marlowe:

In your letter dated December 28, 2006 you requested a classification ruling on behalf of Veratex, Inc.

The submitted sample, Style Veratex Leaves/Steinmart 63146/Veratx Beverly Glen, is a rug. The flat woven rug is made from jute yarns. The face of the rug is printed with a leaf design and the edges are bound. The rug measures 24 x 36 inches.

The applicable subheading for the rug will be 5702.92.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, woven, not tufted of flocked, whether or not made up, including “Kelem”, “Shucmacks”, “Karamanie” and similar hand-woven rugs: other, not of pile construction, made up: of man-made textile materials: other. The rate of duty is 2.7 percent ad valorem.

The rug falls within textile category 665. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
