RE: The tariff classification of a modular wall jack from China.

Dear Mr. Henry:

In your letter dated December 27, 2007, you requested a tariff classification ruling.

The merchandise under consideration is a Flush Mount Telephone Jack, part number 3533-4W. From the information and picture you provided for this ruling request, the product is a plastic duplex flush-mount wall jack and faceplate combination with one 4 or 6-Pin RJ-11 socket commonly identified as a telephone jack. This item provides a connection between a voice and/or data line, to a communication network or system. The Flush Mount Telephone Jack is designed to fit into a standard single gang electrical wall outlet box with its flush mount faceplate. The RJ series of modular jack connectors are used to connect standard modular RJ series plugs into a broadband and/or telecommunication network or system.

In your letter you suggest classification under 8517.80.1020, Harmonized Tariff Schedule of the United States (HTSUS), as electrical apparatus for line telephony or line telegraphy and parts thereof. However, these wall jacks simply provide a connection within an electrically wired network or system, and are more specifically provided for in heading 8536, HTSUS.

The applicable subheading for the Flush Mount Telephone Jack (P/N 3533-4W) will be 8536.69.4050, HTSUS, which provides for “Electrical apparatusfor making connections to or in electrical circuitsLamp-holders, plugs and sockets: Other: Other.” The general rate of duty will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
