RE: The tariff classification of a woman’s tracksuit from China

Dear Ms. Purcell:

In your letter dated December 19, 2006, you requested a classification ruling.

The sample submitted, style number A7222, is a woman’s tracksuit. The tracksuit consists of a hip-length windbreaker-type jacket and a pair of trousers with a shell composed of a woven perforated 100% polyester fabric. The jacket and trousers are lined with a knit mesh 100% polyester fabric.

The jacket has a full front opening secured by a zipper closure, a ribbed-knit fabric collar, long sleeves with elasticized cuffs, two front pockets at the waist area that are secured by zippers and an elasticized bottom hem with a drawcord tightening.

The pull-on pair of trousers have an elasticized waistband with a drawcord tightening, two side seam pockets, two rear pockets below the waist and long hemmed legs.

In a phone conversation you indicated that the jacket and trousers will be packaged and imported together in equal numbers and sold as a set.

The samples are being returned to you as you have requested.

The applicable subheading for the trousers will be 6211.43.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, women’s or girls’: of man-made fibers: tracksuits: trousers. The duty rate will be 16 percent ad valorem.

The applicable subheading for the jacket will be 6211.43.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, women’s or girls’: of man-made fibers: tracksuits: other. The duty rate will be 16 percent ad valorem.

The trousers fall within textile category 648. The jacket falls within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
