RE: The tariff classification of a hand cart from China

Dear Ms. Parkert:

In your letter dated December 15, 2006, you requested a tariff classification ruling on behalf of Grundorf Corp.

The merchandise is described as the “Road-Runner” collapsible cart. It is a pushcart made of a lightweight, aluminum frame that includes a vertical, spring release handle and a horizontal base that rests on two swivel castors and two wheels. The base extends from 18 inches to 28 inches in length to accommodate various sized loads. The entire cart is collapsible and folds to the size of a briefcase. It weighs 18.3 lbs. and has a load capacity of 300 pounds. Your website indicates that the Road-Runner is ideal for use in the music industry by disk jockeys, musicians, service/delivery personnel and at trade shows.

The applicable subheading for the hand cart will be 8716.80.5090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trailers and semi-trailers; other vehicles, not mechanically propelled; and parts thereof, other vehicles, other, other, other. The rate of duty will be 3.2 percent ad valorem.
