RE: The tariff classification of a petticoat from China and Taiwan.

Dear Ms. Tsiavos:

In your letter dated December 12, 2006, you requested a classification ruling.

You have submitted a sample of a woman’s petticoat constructed of a knit 100% nylon netted fabric, which you refer to as a sexy underslip, style #5454. The sheer 2-layer garment has an elasticized waist and measures 12 inches from the waist to the bottom hem, which includes 3½ inches of knit openwork lace-like fabric on the bottom of each layer. The item appears to be worn under a garment to give it a “full” look and comes in one size that fits all.

The applicable subheading for style #5454 will be 6108.11.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ slips, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: slips and petticoats: of man-made fibers, women’s. The duty rate will be 14.9% ad valorem.

Style #5454 falls within textile category 652. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
