RE: The tariff classification of a girl’s knit shirt from Vietnam

Dear Mr. Ryu:

In your letter dated December 7, 2006 you requested a classification ruling.

Submitted style P-02 is a girl’s long sleeve pullover style shirt manufactured from finely knit cotton fabric. The garment is designed to create the visual impression of a short sleeve placket garment existing over a long sleeve hemmed pullover. The cut and sewn garment has set-in long sleeves, a mock placket with woven plaid trim and a woven plaid collar. For ruling purposes it is assumed the article is sized for girls 7-16.

As you have requested, the sample garment is being returned.

The applicable subheading for style 301832 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pullovers and similar articles, knitted or crocheted, of cotton, women’s or girls’, other. The duty rate will be 16.5 per cent ad valorem.

The garment falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
