RE: The tariff classification of a “shrug” from China.

Dear Mr. Zeitlin:

In your letter dated December 4, 2006, you requested a classification ruling for a “shrug.” on behalf of See Saw Couture, Inc. The sample will be returned, as requested.

The submitted sample, style C003, is an upper body garment, referred to as a ”shrug,” constructed from 80 percent cotton, 20 percent polyester knit fabric. The shrug covers the shoulders and extends to an area above the bust in front, and covers approximately the upper quarter of the back. The garment has a hood with a drawstring, and long sleeves with rib knit cuffs.

The applicable subheading for style C003 will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: Other: Women’s or girls’. The duty rate will be 10.8% ad valorem.

Style C003 falls within textile category 359. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
