RE: The tariff classification of a chain sprocket from Taiwan

Dear Ms. Moen:

In your letter dated December 5, 2006 you requested a tariff classification ruling on behalf of Nautilus.

The article in question is described as a forged steel chain sprocket for use on indoor cycling bikes. The issue raised in your request is whether the chain sprocket is classified as a part of the cycling bike in heading 9506, Harmonized Tariff Schedule of the United States (HTSUS), or in HTSUS heading 8483, as a chain sprocket. Descriptive information and a photograph were submitted.

Note 3 to chapter 95 of the HTSUS provides that parts solely or principally used with articles of chapter 95 are to be classified with those articles. However, although you may intend to use the sprockets on cycling bikes, which are provided for in chapter 95 under HTSUS heading 9560, there is nothing to indicate that the subject chain sprockets are solely or principally used on cycling bikes. The sprocket appears to be generic in design and of the kind used in the wide range of mechanical applications that utilize chains. Accordingly, we find that the chain sprocket falls to be classified in HTSUS heading 8483.

The applicable subheading for the sprocket will be 8483.90.1010, HTSUS, which provides for forged chain sprockets. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
