RE: The tariff classification of auger bit sets from China.

Dear Mr. Nuristani:

In your letter dated December 1, 2006, you requested a tariff classification ruling.

You state in your letter that item number 36251 is a 6 piece auger bit set made of high carbon steel. The bits are 7 ½ inches long with shanks of 3/8 inch. The sizes of each bit are ¼, 3/8, ½, 5/8, 5/16, and 1 inch. Item number 93892 is a 3 piece auger bit set made of high carbon steel. The bits are 18 inches long and sizes are ¾, 5/8, and ½ inch.

You further state that all the auger bits have cutting parts containing 0.25 percent chromium and do not contain molybdenum, tungsten or vanadium. Additionally, item numbers 36251 and 93892 can both be used with hand or electric drills, principally with hand drills. Submitted literature indicates that these bits are used for woodworking.

The applicable subheading for the auger bit sets will be 8207.50.2070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Interchangeable tools for hand tools, whether or not power operated, or for machine-tools (for example, for pressing, stamping, punching, tapping, threading, drilling, boring, broaching, milling, turning or screwdriving), including dies for drawing or extruding metal, and rock drilling or earth boring tools; base metal parts thereof: Tools for drilling, other than for rock drilling, and parts thereof: With cutting part containing by weight over 0.2 percent of chromium, molybdenum, or tungsten or over 0.1 percent of vanadium: Other: For woodworking. The rate of duty will be 5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
