RE: The tariff classification of a men’s reversible practice jersey from China.

Dear Ms. Lupi:

In your letter dated November 13, 2006, you requested a tariff classification ruling on behalf of Warrior Lacrosse.

Style WJ-Adult is a men’s 100% polyester, reversible, mesh knit practice jersey. The garment will be used for team practice in the sport of lacrosse and for use at lacrosse summer camps. Style WJ-Adult is similar to a tank top and is constructed from two free-hanging layers that are joined at the shoulders, the armholes, the neckline, and the side seams. Style WJ-Adult has oversized armholes, shoulder straps that measure two and one-half inches in width, a low round front neckline, a rear neckline that falls below the nape of the neck, and a hemmed bottom.

The applicable subheading for Style WJ-Adult will be 6109.90.1049, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: T-shirts, singlets, tank tops, and similar garments, knitted or crocheted: of man-made fibers: tank tops and singlets: men’s and boys’: other. The rate of duty will be 32% ad valorem.

We note that the submitted sample is not marked with the country of origin in accordance with Section 304 TA (19 U.S.C. 1304) and 19 CFR Part 134. The country of origin marking on reversible garments may be satisfied by the use of a hangtag, securely affixed in the neck area, that legibly, conspicuously and permanently states, in English, the country of origin of the goods. In addition, textile fiber products imported into the U.S. must also be labeled in accordance with the Textile Fiber Products Identification Act and the rules promulgated thereunder by the Federal Trade Commission. Information on these labeling requirements may be obtained at the FTC website www.ftc.gov (click on “For Business” and then on “Textile, Wool, Fur”).

Style WJ-Adult falls within textile category designation 638. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
