RE: The tariff classification of a men’s knit jacket from China.

Dear Mr. Sachs:

In your letter dated January 26, 2006, you requested a tariff classification ruling. Our response was delayed due to laboratory analysis. As requested, your sample will be returned.

Style 36-810 is a men’s jacket constructed from two 100% polyester knit fabrics, one of which is brushed, with a layer of foamed polyurethane plastic in the center. Based on laboratory analysis, the brushed fabric is not of pile construction. The garment has a self-fabric hood with a drawstring; a full front opening with a zippered closure; long sleeves with rib knit cuffs; pouch pockets below the waist; and a rib knit bottom.

The applicable subheading for Style 36-810 will be 6113.00.9025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: other: coats and jackets: other: men’s or boys’. The rate of duty is 7.1% ad valorem.

Style 36-810 falls within textile category designation 634. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
