RE: The tariff classification of a woman’s cardigan from China

Dear Ms. Yost:

In your letter dated March 9, 2005, on behalf of Rag Race, Inc., you requested a tariff classification ruling. Your sample is being returned as requested.

The submitted sample, style number J607TWRA, is a woman’s wrap cardigan that is constructed from 80% cotton, 20% polyester, knit fabric that is brushed on the inside. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction.

The cardigan features a V-neckline, long sleeves with ribbed cuffs, a full front opening with a tie closure, and a ribbed bottom. The left front panel wraps over the front right panel. The tie circles the garment.

The applicable subheading for the cardigan will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweatersand similar articles, knitted: of cotton: otherother: women’s. The rate of duty will be 16.5% ad valorem.

The cardigan falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
