RE: The tariff classification of Radio Frequency Identification Reader from unknown country.

Dear Mr. Perez:

In your letter dated October 24, 2006 you requested a tariff classification ruling.

The merchandise under consideration is a wireless, mobile radio frequency identification reader (RFID), (model RD5000). It is designed to be installed on material handling equipment like forklifts and clamp trucks, on mobile carts, portable skate wheel conveyors, or even in hard-to-reach locations where a cabled reader would not be practical. The magnetic reader reads an RFID tagged box or pallet to provide identification of all items in the shipment without opening the box or pallet. The reader translates the information from the tag into machine-readable code. This information is transmitted to the interface electronics such as Symbol’s automatic data processing machines. The computer will correlate the RFID with the box or pallet to provide its location and contents. The RFID reader meets Note 5 (b) to Chapter 84, (HTSUS), Harmonized Tariff Schedule of the United States.

The applicable subheading for the Radio Frequency Identification Reader (model 5000) will be 8471.60.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Automatic data processing machines and units thereof; magnetic or optical readers, machines for transcribing data onto data media in coded form and machines for processing such data, not elsewhere specified or included: Input or output units, whether or not containing storage units in the same housing: Other: Other: Other: Other: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
