RE: The tariff classification of Aglumix 01 from Peru

Dear Ms. Borerro:

In your letter dated October 6, 2006, you requested a tariff classification ruling.

In your letter, you indicate that the Aglumix 01 is a tara gum in powder form, which is obtained from the seeds of the tara tree. The product will be used as a stabilizer in food items.

The applicable subheading for the Aglumix 01 will be 1302.39.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Mucilages and thickeners, whether or not modified, derived from vegetable products: Other: Other. The rate of duty will be 3.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
