RE: The tariff classification of Cyclosporine (CAS-59865-13-3), imported in bulk form, from Switzerland

Dear Ms. Fuller:

In your letter dated September 28, 2006, you requested a tariff classification ruling.

The subject product, Cyclosporine

The International Nonproprietary Name (INN) for Cyclosporine is Ciclosporin, which is listed in Table 1 of the Pharmaceutical Appendix to the Tariff Schedule. , is a cyclic peptide consisting of 11 amino acids, produced as a metabolite by (the fungus) Beauveria nivea. When administered systemically, Cyclosporine is used as an immunosuppressive agent for the prevention of organ rejection in, e.g., kidney and liver transplants. You indicate in your letter that Allergan will use Cyclosporine as the active ingredient in a topically administered ophthalmic medicament See NY Ruling Letter J80550, issued to Allergan on February 12, 2003. intended to increase tear production in patients whose tear production is presumed to be suppressed due to ocular inflammation associated with chronic dry eye disease (keratoconjunctivitis sicca).

The applicable subheading for Cyclosporine, imported in bulk form, will be 2933.79.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Heterocyclic compounds with nitrogen hetero-atom(s) only: Lactams: Other lactams: Other: Other.” Pursuant to General Note 13, HTSUS, the rate of duty will be free.
