RE: The tariff classification of a “10 – Piece Template Guide Set” from China.

Dear Miss Suebsang:

In your letter dated September 22, 2006 you requested a tariff classification ruling.

The “10 – Piece Template Guide Set” (item number 95160) is a template guide set constructed of solid brass and designed to be used with most standard hand-held routers. The template guides are used with dovetail fixtures and other special jigs to produce clean duplicate cuts and patterns. A template guide is used to guide and stabilize the router bit. The set is imported packaged for retail sale in a blow mold case and contains seven round template guides of various sizes, two locknuts and one adaptor.

The applicable subheading for the “10 – Piece Template Guide Set” will be 8466.10.8030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts and accessories suitable for use solely or principally with the machines of headings 8456 to 8465, including work or tool holders, self-opening dieheads, dividing heads and other special attachments for machine tools; tool holders for any type of tool for working in the hand: tool holders and self-opening dieheads: other holders for replaceable cutting or drill inserts. The rate of duty will be 3.9%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

Pursuant to title 19 United States Code, Section 3005 The Harmonized Tariff Schedule of the United States is expected to be amended effective 1/1/07. The amendments are expected to affect the classification of your merchandise. Pursuant to Section 3005 c, the report recommending those changes has been sent to the President for proclamation of the changes. Upon the expiration of sixty legislative days, in the absence of Congressional action, the recommended changes will become law. Accordingly based on that recommendation, it is anticipated that your merchandise will be classified in 8466.10.0130 under the 2007 Harmonized Tariff Schedule. Under the circumstances, this classification under the 2007 tariff is advisory only.
