RE: The tariff classification of a gear pump and parts from Italy

Dear Mr. Crawford:

In your letter dated September 19, 2006 you requested a tariff classification ruling on behalf of Crawford International.

The article in question is identified as the “Ultra Pompe” and described as a positive displacement gear pump. The pump is typically used to pump fluids such as asphalt, polymers, fats, hot oils and food additives. You indicate that the pump may be imported as a “bare shaft pump”, without a motor, coupling or base plate, or as a “complete pump package”, which consists of the pump, motor and coupling, all mounted onto a common base plate. You also indicate that the complete pump package may include a reduction gear to lower the rotational speed of the pump shaft.

The applicable subheading for the gear pump, whether or not imported with a motor, coupling, base plate or reduction gear, will be 8413.60.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other rotary positive displacement pumps. The rate of duty is free.

In your request you also inquire as to the classification of various parts for the gear pump. Parts gear pumps are, prima facie, provided for as parts of liquid pumps in subheading 8413.91.9080, HTSUS. However, parts of pumps, such as mechanical seals, valves, gears, gaskets, etc., are generally more specifically provided for in subheadings other than HTSUS subheading 8413.91.9080.

We need additional information in order to issue a ruling on the classification of specific parts for the gear pump. Please provide a detailed description of each part you wish us to consider. The description should identify the material(s) from which the part is made and include an explanation of the function of the part with respect to the operation pump. Please limit your ruling request to a maximum of 5 items of the same class or kind.
