RE: The tariff classification of a two compartment waste bin separator from Italy.

Dear Ms. Hankins:

In your letter dated August 30, 2006, you requested a tariff classification ruling.

The merchandise under consideration is identified as a two compartment waste bin separator, SKU #10038358. The item, which is made from painted metal and stands 30” tall, is commonly used as a recycling bin. The compartments open on a hinge and each compartment houses a plastic bucket that can be removed for dumping or washing. The item can be freestanding or wall mounted. The mounting hardware is included. You have submitted a photograph of the item with your request.

The applicable subheading for the two compartment waste bin separator will be 9403.20.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Other metal furniture, Other: Other.” The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
