RE: The tariff classification of knitted ornamental trimming from China

Dear Ms. Thayer:

In your letter dated August 22, 2006, you requested a tariff classification ruling.

The item in question is identified as knitted ornamental trimming (Item #36-200-6090). You state that it is constructed of nylon fibers and that it is manufactured by a knitting machine to create a fabric strip. The pompons are manufactured by setting up nylon yarns and twisting, cutting to a length of 9mm and making into a ball shape by special equipment. The pompons are attached to the fabric trim piece by hand.

You also indicate that 36-200-6090 is intended to be imported in 100 yard bulk rolls and will be unspooled, cut to length, and attached to greeting cards as an ornamental accessory.

The applicable subheading for the knitted ornamental trimming will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

You state that you believe the correct classification is in subheading 6003.30.6000, HTSUS, which provides for knitted or crocheted fabrics of a width not exceeding 30cm, of synthetic fiber, other. However, the assembling of the fabric and the pompons together makes the item “made up” according to Note 7(e) to section XI, HTSUS.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
