RE: The tariff classification of Paracetamol (CAS-103-90-2), imported in bulk form, from China

Dear Mr. Leifheit:

In your letter dated August 22, 2006, you requested a tariff classification ruling.

The subject product, Paracetamol, which is the International Nonproprietary Name (INN) for Acetaminophen, is principally used in the United States as an analgesic and antipyretic drug. You indicate in your letter that you do not intend to use the subject product as a drug.

Pursuant to note 1(a)

“In the absence of special language or context which otherwise requires - (a) a tariff classification controlled by use (other than actual use) is to be determined in accordance with the use in the United States at, or immediately prior to, the date of importation, of goods of that class or kind to which the imported goods belong, and the controlling use is the principal use.” of the Additional Rules of Interpretation, HTSUS, the applicable subheading for Paracetamol (aka: Acetaminophen, APAP), imported in bulk form, will be 2924.29.6210, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Carboxyamide-function compounds; amide-function compounds of carbonic acid: Cyclic amides (including cyclic carbamates)and their derivatives; salts thereof: Other: Aromatic: Other: Drugs: Other: Acetaminophen.” The rate of duty will be 6.5 percent ad valorem. At the present time, neither “Paracetamol,” “Acetaminophen,” nor “APAP” is listed in the Pharmaceutical Appendix to the Tariff Schedule.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
