RE: The tariff classification of an inverter from China

Dear Ms. Malina:

In your letter dated June 26, 2006, you requested a tariff classification ruling.

The merchandise subject to this ruling is identified as an inverter. This item is made of molded plastic with 2 screws and contains a 3.7-volt lithium battery with a built-in protective circuit and has an operating output of 135 volts and 1300 hertz. The inverter, which measures 80mm x 47mm x 23mm, is designed to be used with backpacks and other bags to illuminate them when carried by the wearer during the evening hours.

The applicable subheading for the inverter will be 8504.40.9570, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical transformers, static converters (for example, rectifiers) and inductors; parts thereof: Other: Inverters.” The rate of duty will be 1.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
