RE: The tariff classification of a “Devil Head Band” from China.

Dear Ms. Aldinger:

In your letter dated June 23, 2006, you requested a tariff classification ruling.

You submitted a photograph of a “Devil Head Band” identified as item number 946608, which is a headband with attached plastic devil horns. The rigid headband is horseshoe-shaped and made of polyester fabric and polyester fiber stuffing. The rigidity of the headband is what keeps the headband on the head and the horns upright. The “Devil Head Band” is intended for use as a costume.

The applicable subheading for the “Devil Head Band” identified as item number 946608 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be free.
