Dear Mr. Nuristani:

In your letter dated June 5, 2006, you requested a tariff classification ruling.

The merchandise at issue is two wheelbarrows. Item number 93985 is a 6 cubic foot, self-dumping wheelbarrow made predominantly of carbon steel. It has two 14-inch pneumatic tires and measures 52 inches long by 29 inches wide by 38 inches high. It weighs 60 lbs. and has a weight capacity of 330 lbs. Squeezing the release cable handle activates its self-dumping feature by moving the tray up to dump.

The applicable subheading for the wheelbarrows will be 8716.80.5090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trailers and semi-trailers; other vehicles, not mechanically propelled; and parts thereof, other vehicles, other, other, other. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.
