RE: The tariff classification of a portable FM/clock radio from China.

Dear Mr. Crago:

In your letter dated May 19, 2006 you requested a tariff classification ruling.

The item in question is a portable battery operated FM/clock radio. It is a functional radiobroadcast receiver that enables the user to carry it while listening to radio broadcast programming. It also incorporates a digital LCD clock. The item is valued under $40 and is not designed for motor vehicle use.

The applicable subheading for the portable FM clock radio will be 8527.19.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Reception apparatus for radiotelephony, radiotelegraphy or radiobroadcasting, whether or not combined, in the same housing, with sound recording or reproducing apparatus or a clock: Radiobroadcast receivers capable of operating without an external source of power, including apparatus capable of receiving also radiotelephony or radiotelegraphy: Other: Valued not over $40 each, incorporating a clock or clock-timer, not in combination with any other article, and not designed for motor vehicle installation. The rate of duty will be free.
