RE: The tariff classification of a garden hook from China

Dear Ms. Schaffer:

In your letter dated May 18, 2006, you requested a tariff classification ruling.

The merchandise is a steel shepherd garden hook. Your letter states that it is used for hanging plants. It consists of several tubular pieces that join together to form a stake that stands approximately 90 inches tall, and six curved rods with loops at their ends from which the plants hang.

The applicable subheading for the shepherd’s hook will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bells, gongs and the like, nonelectric, of base metalstatuettes and other ornaments, and parts thereof, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
