RE: The tariff classification of a wall hanging from China.

Dear Ms. Gauthier:

In your letter dated May 8, 2006 you requested a classification ruling on behalf of CVS/Pharmacy.

You will be importing a wall hanging described as “20 inch Stuffing Scarecrow Strip with Sign Wall Hanging” (CVS item 345707). A photo of the wall hanging was submitted with your request. The item consists of a wooden “Welcome” sign with three dangling scarecrows attached to it. The scarecrows are made of polyester fabric stuffed with a polyester filler. The scarecrows are attached to each other and the top scarecrow attaches to the wooden sign by means of a wire. Affixed to the top portion of the wooden sign is a metal wire used to hang the item from a wall.

The applicable subheading for the wall hanging will be 6304.93.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of synthetic fibers. The duty rate will be 9.3 percent ad valorem.

The wall hanging falls within textile category designation 666. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
